Definitions
“Services” refers to all logistics and freight forwarding services provided by JMS Express Clearing Forwarding Pvt. Ltd. “Customer” means any person or entity utilizing our services. “Goods” refers to items or cargo handled, transported, or stored by us on behalf of the customer.Scope of Services
JMS Express provides services such as transportation, customs brokerage, warehousing, packaging, and freight forwarding in accordance with applicable laws and industry standards. Our role is limited to the specific services outlined in the service agreement or contract, and JMS Express does not act as an insurer of goods.Obligations of the Customer
Customers are responsible for providing accurate and complete information related to the goods, including but not limited to:- Description of goods
- Quantity, weight, and dimensions
- Value for customs declaration The customer must comply with all applicable laws and regulations, including customs and import/export laws. JMS Express is not liable for delays, penalties, or other issues arising from the customer’s failure to provide accurate documentation or comply with regulations.
Payment Terms
All charges for services must be paid in full within the timeframe specified in the invoice unless otherwise agreed in writing. JMS Express reserves the right to withhold goods or suspend services for overdue payments. Additional charges may apply for storage, demurrage, or other ancillary services.Limitation of Liability
JMS Express’s liability for loss or damage to goods is limited to the lower of the following:- The actual value of the goods
- Compensation limits specified under applicable international conventions
- Loss or damage caused by force majeure events, including but not limited to natural disasters, strikes, or war.
- Indirect or consequential damages, such as loss of profit or market.
